Probate & Succession

Probate is the term for a legal process in which a Will is reviewed to determine whether it is valid and authentic by the relevant Court. Probate also refers to the general administering of a deceased person's Will or the estate of a deceased person without a Will. After an asset-holder dies, the Court appoints either an executor named in the Will or an administrator (if there is no Will) to administer the process of probate. This involves collecting the assets of adeceased person to pay any liabilities from the deceased person's estate, and to distribute the assets to the rightful beneficiaries. Our Advocates advise our Clients, represent their interests in the matter and assist them in interpreting the Wills and related documents as well as filing the necessary documentation in Court. Due to the sensitive nature of such matters, it is imperative for Advocates to wak the Client through every step from making applications and submitting evidence to Court, to representing their interests, to obtaining orders and finally executing the same.

Due to the arduous nature of litigation in Kenya, relatively small disputes may be left at the back of the queue and result in time-consuming Court processes which often bring projects or contractual services to a standstill, costing both parties dearly until the dispute is resolved. As a result, the majority of contracts across most industries include provisions for Mediation and Arbitration. This is to avoid time-consuming litigation, by referring the matter to mediation where the parties negotiate a settlement in good faith with the assistance of a mediator. Our team ensures that any agreement reached has been captured in writing as per the terms agreed upon by the parties and that our Client is not exposed to any concealed consequences. Should mediation fail within the allocated time, these disputes are often forwarded for Arbitration, where the parties involved submit their respective cases before the appointed Arbitrator. In such cases, as the Arbitrator's decision is considered binding (in the majority of matters), it is advisable to have an Advocate confirm the position of the Client's case, consider the terms of the agreement, the action of the offending party and the likely consequences of any alleged breach. Our Advocates review the strengths and weaknesses of a Client's claim and subsequently canvas the Client's argument emphasizing the strengths of their cases and strive to gain judgment in our Clients favour.
